Terms and Conditions


    We, at CashUp, whose registered office is situated in Islamabad, Pakistan (hereinafter referred to as “CashUp” or “Company” or “us” or “we” or “our”), own the mobile application “CashUp” (the “App”) and the website at www.cashup.pk (the “Website”). The App and Website are together the “Platform”.

    Please read these Terms & Conditions carefully before You (“User” or “You” or “Your”) use the Platform. By accessing or using any Services (defined below) facilitated on the Platform by CashUp and/or its service providers/third-party partners (“Platform Partners”), YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND UNCONDITIONALLY AGREE TO BE BOUND BY THESE TERMS & CONDITIONS. If You do not agree, do not access the Platform or use any Services.

PART A: GENERAL TERMS AND CONDITIONS

1. Introduction


    1.1 CashUp facilitates, either directly or through Platform Partners, various services to customers, including but not limited to:

      1.1.1 Facilitating the disbursement of lending products/loans offered by lending partners (i.e., regulated entities registered with the State Bank of Pakistan (SBP) and/or the Securities and Exchange Commission of Pakistan (SECP), whose details are available on the Website, the App and application stores) on the Platform (“Digital Lending Services”).

      1.1.2 Provision of additional products/services (not related to Digital Lending Services) on the Platform, including but not limited to digital gold products, insurance products/services, and any other services that may be introduced from time to time (“Additional Services”).

    1.2 If You wish to avail any Services on the Platform, You may need to provide certain information and our representatives may contact You via phone or email to understand Your requirements.

2. Eligibility


    2.1 You represent that You are a natural/legal person at least 21 years of age and legally permitted to enter into a contract and avail the Services in Pakistan, subject to these Terms & Conditions.

    2.2 If You violate these Terms & Conditions, or are not capable of entering into a binding contract or availing the Services, CashUp may terminate Your membership, delete Your account/profile and/or prohibit access to the Platform at its sole discretion, with or without notice (including if CashUp believes You are under 21 years).

3. Acceptance of Terms and Conditions


    3.1 These Terms & Conditions form an agreement between (a) You and (b) CashUp, governing Your access to/usage of the Platform and the terms for availing Services facilitated via Platform Partners. “Users” include consumers, financial institutions, regulated entities, and other Platform Partners.

    3.2 These Terms & Conditions incorporate by reference: (a) our Privacy Policy (available at www.cashup.pk/privacy-policy); and (b) any agreement(s) executed by You (and co-applicants/nominees, if any) for availing Services from us and/or Platform Partners.

    3.3 If You do not agree to these Terms & Conditions, please refrain from using the Platform.

    3.4 All Services are subject to applicable laws, regulations, rules and guidelines. CashUp may change, modify, add or remove portions of these Terms & Conditions or update the Platform/Services at any time. Continued use constitutes acceptance of changes.

4. Your Account


    4.1 To avail Services, create an account and register with Us, providing information as detailed in our Privacy Policy. The App is deemed in use when loaded in device memory. Revoking mandatory permissions may limit/restrict App use.

    4.2 You are responsible for maintaining confidentiality/security of Your account and password and for all activities under it. Notify Us immediately of any unauthorized use. Ensure details provided are true, correct, accurate and complete.

    4.3 If CashUp knows/suspects the information You provided is wrong, inaccurate or incorrect, CashUp may terminate Your account without notice, suspend Services and/or take other actions. Notify Us promptly of any changes to Your information.

    4.4 You can access/update most information in Your dashboard after login or by writing to dataprivacy@cashup.pk. The right to use the Platform is personal and non-transferable.

    4.5 Breach of these Terms & Conditions may lead to termination and civil/criminal remedies under the laws of Pakistan.

5. Privacy


    5.1 CashUp collects certain information to create Your account and facilitate Services. Use of Your personal information is governed by our Privacy Policy.

    5.2 Please refer to the Privacy Policy for details on information and permissions/consents sought during account creation and subsequent use of the Platform/Services.

6. License and Access


    6.1 CashUp grants You a limited, non-transferable license to access and use the Platform to avail Services. No downloading (other than page caching), modifying, reproducing, duplicating, copying, distributing, framing, data mining, or reverse engineering any part of the Platform without express written consent. Unauthorized use terminates the license.

    6.2 You may use content delivered through the Service only for that Service. You may not copy, reproduce, distribute, create derivative works, reverse engineer/compile Service technology (including Java applets).

7. Monitoring of the Platform and Your Account


    7.1 CashUp may monitor Platform content and Your activity (including information in Your account) to verify information and ensure compliance, and may remove objectionable content or share information with authorities as per applicable procedures/laws of Pakistan.

8. Service Suspension


    8.1 CashUp may stop providing Services and terminate Your use at any time without notice. Upon termination, rights and licenses end and You must stop using the Platform. CashUp may suspend/cease any Service without liability.

9. Prohibited Uses


    9.1 You agree not to engage in illegal/unauthorized activities, including:


      9.1.1 Restricting or inhibiting authorized Users from using the Platform;

      9.1.2 Unlawful purposes or soliciting unlawful acts;

      9.1.3 Violating applicable laws/regulations;

      9.1.4 Collecting/tracking Users’ information without consent;

      9.1.5 Framing/mirroring any part of the Platform without authorization;

      9.1.6 Spamming/flooding;

      9.1.7 Transmitting malware/viruses/harmful code;

      9.1.8 Removing IP notices or infringing IP rights;

      9.1.9 Data mining/scraping to circumvent Platform structure;

      9.1.10 Sharing access with unauthorized persons;

      9.1.11 Harassment/abuse/hate speech/discrimination;

      9.1.12 Submitting false/misleading information;

      9.1.13 Spam, phish, pharm, pretext, spider, crawl, scrape.

    9.2 If suspected, CashUp may terminate Your use of the Service/Platform or take other appropriate actions.

10. Limitation of Liability and Disclaimer of Warranties


    10.1 To the maximum extent permitted by law, CashUp and its affiliates/subsidiaries/officers/directors/employees/agents shall not be liable for indirect, incidental, special, consequential damages or loss of profits. You waive and release claims arising out of Your use of the Platform.

    10.2 Information on the Platform is based on inputs provided to CashUp. CashUp is not responsible for undisclosed information, loan defaults (lenders retain remedies), or Users’ misrepresentations. Users must conduct their own diligence.

    10.3 CashUp makes no representations/warranties on behalf of Platform Partners for their products/Services. Liabilities/obligations for Services availed from Platform Partners are governed by Your separate agreement(s) with them.

    10.4 THE SERVICE AND ALL INFORMATION/PRODUCTS/CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES (EXPRESS OR IMPLIED), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, ACCURACY OR ERROR-FREE OPERATION.

    10.5 NEITHER CASHUP NOR THIRD-PARTY PROVIDERS SHALL BE LIABLE FOR ANY DIRECT/INDIRECT/INCIDENTAL/SPECIAL/CONSEQUENTIAL/EXEMPLARY DAMAGES ARISING FROM USE/INABILITY TO USE THE SERVICE/PLATFORM, SUBSTITUTION COSTS, UNAUTHORIZED ACCESS, STATEMENTS/CONDUCT OF OTHERS, OR OTHER MATTERS. The maximum liability of CashUp is limited to the amount actually paid by You to CashUp for the Service.

11. Indemnity


    11.1 You agree to indemnify and hold harmless CashUp and its affiliates/contractors/employees/officers/directors/agents/service providers from claims, losses, damages, liabilities, costs and expenses (including legal fees) arising out of Your use/misuse of the Services/Platform, violation of these Terms/Privacy Policy/other documents, breach of representations/warranties/covenants, or infringement of rights. CashUp may assume defense at Your expense; this clause survives termination.

13. User Comments, Feedback and Other Submissions


    13.1 If You send submissions/comments (online/email/post etc.), We may edit/copy/publish/distribute/translate/use them without restriction or obligation to maintain confidentiality, compensate, or respond.

    13.2 You warrant comments do not violate third-party rights and are not unlawful/abusive/obscene/malicious; You will not mislead as to origin. You are solely responsible for comments and accuracy.

    13.3 You license to CashUp (and service providers) any information/data/materials (“Content”) You provide to deliver the Service, including rights to use/modify/display/distribute/create new material and to use aggregate, non-personally identifiable information.

14. Acknowledgements


    14.1 CashUp is a platform connecting Users; it does not itself grant or borrow money. Use of financial products is based on negotiations between Users and third parties. CashUp does not warrant third-party services, Users’ information, or repayment; Users must verify information independently.

15. Applicable Laws


    15.1 Your use of the Platform and these Terms & Conditions are subject to the laws of the Islamic Republic of Pakistan. Courts of Karachi shall have exclusive jurisdiction over disputes.

PART B: Digital Lending Services


    1.1 The Platform facilitates loan products offered by banks and/or non-bank financial companies regulated by the State Bank of Pakistan (SBP) and/or the Securities and Exchange Commission of Pakistan (SECP) (“Digital Lending Services”). If You wish to avail any loan product, You can do so on the Platform.

    1.2 The Platform is a digital lending application that facilitates Digital Lending Services offered by lending partners listed/empanelled with Us. CashUp does not directly provide such lending products/services. Your relationship with lending partners is governed by their respective terms and privacy policies and the agreement(s) You execute with them.

    1.3 Please refer to our Privacy Policy for details on information and permissions/consents sought by Us and the Lending Partners in providing Digital Lending Services.
